NO SURPRISES ACT 2022

To the NAAP Membership:

Many of our members have requested information about the  federal No Surprises Act (NSA). Below is a description of impact based on the recent NY Governor’s Executive Budget proposal. While this is in reference to NY state, it reflects the bearing, as currently known, of the No Surprises Act on licensed or state certified psychoanalysts, in general.

Governor Kathy Hochul has released her first Executive Budget for the 2022-2023 NYS fiscal year.  Included in her funding plan was a proposal to align New York state consumer protections with the recently enacted federal No Surprise Act (NSA).

According to a support memo released with the proposal, Governor Hochul indicated that the “NSA provides federal consumer protections against surprise billing, limits out of network cost sharing under many of the circumstances in which surprise bills arrive most frequently (eg. balance billing, provider directory inaccuracies), and establishes continuity of care and health plan ID requirements.”

We are continuing to monitor the legislation and will provide you with updates as they become available.
